Oklahoma Workers Compensation and Death Claims
The loss of a family member is a difficult journey. It is a small comfort to know that employers are not immune from suit in a worker’s compensation claim if the employee dies on the job. Worker’s compensation death benefits are complicated, as they are subject to several regulations. The spouse is entitled to 70% of the deceased’s wages from employment. In addition, this amount can be supplemented with 15% for each child, with a maximum of 30% of the deceased wages. A spouse who remarries is entitles to recieve two years worth of payments in a lump sum, and benefits terminate.
